By accessing or using the mogozen.com website and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms apply to all visitors, users, and others who access or use the Services. We reserve the right to update these Terms at any time. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
2. Description of Services
Mogozen provides an informational website about the CG Deck product, a waitlist registration service, documentation and community resources, and a support request system. The CG Deck is a pre-launch product; no purchases or orders are processed through this website at this time.
3. Use License
Permission is granted to access and view the materials on our website for personal, non-commercial use only. This is the grant of a license, not a transfer of title. Under this license you may not:
- Modify, reproduce, or copy the materials without prior written consent
- Use the materials for any commercial purpose or public display
- Attempt to decompile or reverse engineer any software on the website
- Remove any copyright or proprietary notations from the materials
- Transfer the materials to another person or mirror them on another server
- Scrape, crawl, or use automated tools to extract data from the website
This license shall automatically terminate if you violate any of these restrictions. Open-source hardware and software components of the CG Deck project are governed by their respective open-source licenses as published on our GitHub repository.

By registering on our waitlist, you agree to receive email communications from Mogozen including product updates, launch announcements, and promotional content. You may opt out of marketing communications at any time by:
- Clicking "Unsubscribe" in any marketing email
- Emailing support@mogozen.com with "Unsubscribe" in the subject line
Transactional and service-related communications (such as responses to support requests) are not subject to opt-out as they are necessary for providing the Services.
6. Disclaimer of Warranties
The materials and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Mogozen does not warrant that the website will be uninterrupted, error-free, or free of viruses. Product specifications, timelines, and features described on the website are subject to change without notice as the CG Deck is a pre-launch product still in development.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Mogozen and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use of or inability to use the Services.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of $0 (as no monetary transaction currently takes place on this website) or the amount you have paid to Mogozen in the 12 months preceding the claim.

Mogozen is committed to full compliance with all applicable intellectual property laws and international copyright agreements, including but not limited to the Digital Millennium Copyright Act (DMCA) and applicable EU copyright directives. We do not knowingly promote, distribute, reproduce, or sell any materials, software, firmware, or content that is protected by copyright, trademark, patent, or any other form of intellectual property protection without express authorization from the rights holder.
All hardware design files, schematics, and software associated with the CG Deck project that are released as open-source are done so exclusively under their designated open-source licenses (as published on our GitHub repository), which dictate the permitted uses, attribution requirements, and distribution rights applicable to those materials.
If you believe that any content on our website or associated with our services infringes upon your intellectual property rights, please contact us immediately at support@mogozen.com with the subject line "IP / Copyright Claim" and we will investigate and respond promptly.
8. Accuracy of Materials
The materials on our website may include technical, typographical, or photographic errors. Mogozen does not warrant that any materials are accurate, complete, or current. Product renders and specifications are conceptual and subject to change. We reserve the right to make changes to materials at any time without notice.

The CG Deck name, Mogozen name, and associated branding are proprietary. Open-source components are governed by their respective licenses.

If you are located in the EEA, UK, or Switzerland, your use of our Services is subject to the General Data Protection Regulation (GDPR) and applicable local data protection laws. By using our Services, you acknowledge that your personal data may be processed as described in our Privacy Policy.

Under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), California residents have the right to know what personal information is collected, request deletion, correct inaccurate information, and opt out of the sale or sharing of personal information.
Mogozen does not sell or share your personal information. To submit a privacy rights request, email us at support@mogozen.com with the subject line "California Privacy Request." We will respond within 45 days. You will not be discriminated against for exercising your rights.
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration, except where prohibited by applicable law.
Nothing in these Terms limits your statutory rights under applicable consumer protection laws in your jurisdiction, including EU consumer rights directives or California consumer protection statutes.

Mogozen reserves the right to revise these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. For material changes, we will make reasonable efforts to notify users via email (if you are on our waitlist) or by a notice on the website. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.
